What is the SAFETY Act?

The Support Anti-terrorism by Fostering Effective Technologies Act of 2002 is a federal program that provides liability protections to sellers of qualified anti-terrorism technologies (QATTs).

Origins: a post-9/11 response

After the attacks of September 11, 2001, U.S. policymakers recognized that private companies with promising security technologies were reluctant to deploy them at scale. The reason was straightforward: if a terrorist attack occurred and their product was involved, the resulting liability could be catastrophic — often larger than the company itself.

Congress addressed this by enacting the Support Anti-terrorism by Fostering Effective Technologies Act (the "SAFETY Act") as Subtitle G of the Homeland Security Act of 2002. The program is administered by the U.S. Department of Homeland Security's Science and Technology Directorate through the Office of SAFETY Act Implementation (OSAI).

The premise is simple: if a technology is reviewed and approved by DHS, and later an act of terrorism occurs, the seller's liability exposure is limited by federal law — encouraging development, deployment, and use of effective anti-terrorism technologies.

Two tiers: Designation and Certification

The Act creates two distinct levels of approval. Both are meaningful; they differ in the depth of review and the strength of the liability protections that attach.

Designation

DHS finds the technology has proven effectiveness and utility. Sellers receive:

  • Liability capped at a set insurance amount
  • Exclusive federal court jurisdiction
  • No punitive damages or prejudgment interest
  • Bar on joint & several liability for non-economic damages

Certification

A higher standard — the technology will perform as intended and is effective for defeating acts of terrorism. Sellers receive everything above, plus:

  • Rebuttable presumption of the government contractor defense
  • Placement on DHS's Approved Product List for Homeland Security

What the liability protections actually do

The protections activate only in the event of an "act of terrorism" formally designated by the Secretary of Homeland Security. When that happens, plaintiffs can bring claims against the seller of a SAFETY Act–approved technology, but those claims are:

  • Consolidated in federal district court
  • Capped at the DHS-set insurance requirement (which the seller must carry)
  • Barred from including punitive damages and prejudgment interest
  • Not subject to joint & several liability for non-economic damages beyond the seller's share of responsibility

For Certified technologies, the government contractor defense creates a strong rebuttable presumption that the seller met the standard of care — a very high bar for plaintiffs to overcome.

Why it matters for modern threats

The SAFETY Act was written in the shadow of 9/11, but its scope is broader. DHS has extended approvals to technologies addressing evolving threats: active-shooter detection, cyber intrusion, drone mitigation, secure venue operations, chemical and biological detection, and physical access control. Any product, service, software, system, or training program that provides an anti-terrorism benefit may be eligible.

For venue operators, corporate security teams, and public agencies, the presence of SAFETY Act–approved technologies in the security stack can also inform their own risk posture and, in some cases, their downstream liability profile.

What SAFETY Act status is not

  • It is not an endorsement, recommendation, or ranking by DHS.
  • It is not a guarantee of quality or a substitute for due diligence.
  • It is not permanent — approvals have terms and must be renewed.
  • It does not eliminate all liability — it structures and caps it.
